The truth about Whitefriars press release called Tenant gets last chance

Mr kybird living at 131 longfield house was served a demotion order by Coventry County Court in which he was not legally represented. after which Whitefriars issued a press release which is factually wrong and significantly misleading.

For example where it says:
"Whitefriars took the measure thanks to local residents who recorded details in diary sheets of the problems they suffered"
When in fact it was thanks to the dairy sheets of one tenant called Mr Haden, who the environmental services (who were monitoring the nuisance) refused to use as evidence because as they said in a fax to Ms Lyn Gillespie Whitefriars enforcement officer
" Mr Haden complained about hammering and sawing from 131 on the diary sheets and recorded this on the machine. This was definitely coming from Mr Hadens flat (right next to the microphone) which is a shame" (see court case file page 111 claim No 6CV02013)
In other words Mr Haden was manufacturing the noise himself and blaming Mr Kybird.

In the press release Mr Tony Marsella, of the asb4 team at Whitefriars, said ""We believe this is the right decision for Mr Kybird and also his neighbours."
This is a very surprising conclusion considering all Mr Kybirds neighbours except Mr Haden signed a petition refuting the allegations of noise nuisance being made and endorsed him as a good neighbour " (see court case file page 309) In addition the chairman of the residents association represented him in court instead of legal representation that he was unable to obtain.

Further the judge ordered that he pay £ 4,574 pounds legal costs.

Tony Marsella says further that "Eviction is always a last resort" however Ms Gillespie did not discuss the option of mediation and according to her own case report considered mediation not applicable. (see court case file page 107)

The latest position is that Mr kybird has now received a Notice requiring possession on 5th February 2007. presumably based on more of Mr Hadens discredited dairy sheets ( a proven liar and court perjurer)

The referenced court case documents are buried amongst the 354 pages which the judge probably did not read but can be made available.

And probably explains why Mr Marsella has given such a twisted and convoluted account which this blog hopes to redress or at least set the record straight.
Twisted and convoluted because whitefriars preferred to shoot the messenger rather then address the problems that the residents association raised.

For those who wonder why Mr kybird was not able to get legal representation the answer is simple. In Coventry there are no solicitors willing to take up housing issues on legal Aid and so people are referred to the Coventry law centre who must be phoned for initial advice on tell 7625 3167 on Monday & Wednesday between 2.00 pm and 4.00 pm.
The problem is no one ever seems to be able to get through because it is continually engaged. Whitefriars presumably know this, so they can do what they want knowing that there tenants will not get legal representation.
If you don’t believe this try phoning yourself.

One might have thought the local newspaper might have printed a correction to their printed story (the Coventry Observer page 12 September 28 2006) having received numerous letters from mr kybirds neighbours in his support and checked the facts from the court file but to date they have not do so.

Mr Howard farrand Chief executive of whitefriars has been e mailed howard.farrand@whitefriarshousing.co.uk so he is aware of the press release but has to date taken no action to correct it.
The local Coventry City labour councillor Mr Sacha Bains has also been informed (Sucha.Bains@coventry.gov.uk) but to date has also made no reply.

On a more positive Note Mr Kybird is receiving help and support from the Coventry Cyrenians who have seen the court documents refered to and were flabbergasted at the action whitfriars has taken. In addition the Coventry Citizens advice Bureau have advised me kybird to seek specialist advice regarding the validity of the demoted tenancy agreement which is unfortunately the un-contactable Coventry Law centre.

As things stand Mr Kybirds experience represents the state of summary justice in Coventry which has set a new standard which could effect all whitefriars tenants particularly those that make legitimate complaints about the management, security and repairs of the Whitefriars housing group.

If you are reading this and live in the upper stoke area please do not vote for the labour candidate at the next local elections and bear in mind that the new court tenancy demotion process originates directly from the Deputy Prime Ministers office; who have also been informed of how the process has been abused by the social landlord Whitefriars and in this case has only served to undermine the confidence of longfield house tenants in both the Coventry county court and the honesty of whitefriars security and enforcement employees..
